Four men charged in the fatal shooting of a tourist on Stearns Wharf appeared in Santa Barbara County Superior Court Thursday morning, when their preliminary hearing setting was continued to May 4.
Three of the four men are being charged with the murder of 52-year-old Robert Dion “Rob” Gutierrez from Camarillo, who Santa Barbara Police have said was an “innocent bystander” when members of two criminal street gangs exchanging gunshots on Stearns Wharf on Dec. 9.
Santa Barbara police said Gutierrez was “an innocent bystander who was in Santa Barbara with his wife walking on Stearns Wharf when he was struck and killed by one of the rounds fired during an altercation between two groups of individuals at the base of the wharf.”
Jiram Tenorio Ramon, 23; Christopher Dave Miranda, 21; and Ricardo Tomas Jauregui-Moreno, 20, have been charged with murder and other crimes, and 21-year-old James Lee Rosborough has been charged with being an accessory after the fact.
The four men are accused of committing the crimes for the benefit of the Santa Barbara Westside criminal street gang. They have pleaded not guilty to all charges and special allegations.
Three juveniles, all residents of Ventura County, have also been charged in connection with the shooting. Two of them have been charged with murder, and their cases are going through the juvenile justice system.
Senior Deputy District Attorney Tate McAllister is prosecuting the case for the Santa Barbara County District Attorney’s Office.
Tenorio Ramon is being represented by defense attorney George Steele and defense attorney Meghan Behrens is representing Miranda.
Defense attorney Neil Levinson is representing Rosborough and defense attorney Andrea Keith is representing Jauregui-Moreno.
All four Santa Barbara men are being held in the Santa Barbara County Main Jail without bail.
Rosborough had a bail review hearing scheduled for Thursday morning, but that was also continued to May 4.
