The Nevada man accused of attacking and seriously injuring a woman at a Montecito mansion has been deemed competent to stand trial and will face a preliminary hearing in August.

Russell Maxwell Phay, 42, is accused of attempted murder, assault, kidnapping, residential burglary, and other crimes after allegedly violently attacking Linda Malek-Aslanian on May 21 at the home of Ty Warner, a hotelier and Beanie Babies mogul.

Phay appeared in Superior Court Monday morning for a competency hearing wearing jail clothing. His attorney, public defender Brian Mathis, said Phay has stabilized since his last court hearing. 

Phay was ordered to be evaluated by two psychologists, and both reports determined he was competent to stand trial. Judge Stephen Foley agreed with the evaluations and scheduled a preliminary hearing for Aug. 25 at 8:30 a.m.

The incident at Ty Warner’s mansion spurred a large law enforcement response and standoff.

The Sheriff’s Office said Phay attacked a women at the home and then barricaded himself in a bathroom. Phay allegedly tried to escape law enforcement by jumping out a window onto the ground. He was arrested at the Fairway Road home and booked into jail custody.

Phay allegedly inflicted great bodily injury to Malek-Aslanian, “causing the victim to become comatose due to brain injury,” the District Attorney’s Office said in the criminal complaint.

Warner was home at the time of the attack but reportedly was not hurt.

Phay has pleaded not guilty to all charges and denied all allegations. 

No details have been released on how or why Phay, who is from Henderson, Nevada, ended up at the home during the May 21 incident.
